Terms of Use.

These Terms of Use ("Terms") govern your access to and use of the website pelyr.com and the PELYR maritime dashboard / web application (together, the "Service"), operated by Timo Zürner (the "Operator"; see the legal notice). By accessing or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
1. The Service
PELYR is a private, non-commercial project that visualises live and historical maritime (AIS) data and related analytics for informational and situational-awareness purposes. The Service is provided free of charge and "as is", without any warranty (see Section 9). The Operator may add, change, restrict or discontinue features at any time.
2. Public access and user accounts
The public map and publicly available vessel data can be viewed without an account. Certain features (e.g. operator and administration areas, restricted port analytics) require a login.
- Accounts are created and assigned by the Operator; there is no public self-registration.
- You are responsible for keeping your login credentials confidential and for all activity that occurs under your account.
- You must notify the Operator promptly of any unauthorised use of your account.
- Access rights are tied to your assigned role and may be changed or revoked at any time.
3. Acceptable use
When using the Service you agree not to:
- use the Service in violation of applicable law or third-party rights;
- attempt to gain unauthorised access to the Service, other accounts, or the underlying systems, or to circumvent security or access controls;
- interfere with or place an unreasonable load on the Service, including automated mass requests, scraping, or bypassing rate limits;
- disrupt, probe or attack the infrastructure (e.g. denial-of-service attempts);
- copy, redistribute or commercially exploit data obtained through the Service beyond what the applicable third-party data licences permit (see Section 7);
- misrepresent your identity or your authorisation to use a feature.
The Operator may suspend or terminate access that violates these Terms or threatens the security or availability of the Service.
4. Maritime and AIS data — important safety notice
The maritime data shown in the Service (including AIS positions, vessel details, routes, anchorages and seamarks) is sourced from third parties and from publicly broadcast signals. It may be incomplete, delayed, inaccurate or unavailable. The Service is provided for information and situational awareness only and must not be used for navigation, collision avoidance, or any safety-critical or operational decision. Always rely on official, certified navigation systems and information sources. The Operator accepts no liability for decisions made on the basis of data shown in the Service.
5. Availability
The Service is provided on a best-effort basis. There is no guaranteed availability, uptime or service level. Access may be interrupted, limited or discontinued at any time, for example for maintenance, technical reasons, or at the Operator's discretion, without prior notice.
6. Intellectual property
The Service, its software, design, the "PELYR" name and logo, and the content created by the Operator are protected by intellectual-property rights and remain the property of the Operator or its licensors. Except as expressly permitted, you may not reproduce, modify, distribute or create derivative works from them without prior written consent.
Maritime, map and nautical data are subject to the rights and licences of their respective providers — including © OpenStreetMap contributors (Open Database License), OpenSeaMap, MapToolkit, and the AIS data source. You are responsible for complying with those licences when you use such data.
7. Third-party services and links
The Service integrates third-party data and may link to external websites over whose content the Operator has no control and for which it assumes no responsibility. The respective provider is responsible for their own content and terms.
8. Data protection
Information on how personal data is processed is set out in our Privacy Policy, which forms part of these Terms.
9. Disclaimer of warranties
To the extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including as to accuracy, completeness, fitness for a particular purpose, uninterrupted availability, or freedom from errors. This does not exclude liability that cannot be excluded under mandatory law.
10. Limitation of liability
To the extent permitted by applicable (in particular Austrian) law, the Operator is liable only for damage caused intentionally or by gross negligence. Liability for slight negligence is excluded, except for damage resulting from injury to life, body or health, and except for the breach of essential contractual obligations; in the latter case liability is limited to foreseeable, typical damage. In particular, the Operator is not liable for decisions or actions taken on the basis of data shown in the Service (see Section 4), nor for damage arising from unavailability of the Service. Mandatory statutory liability (including under consumer-protection law) remains unaffected.
11. Changes to these Terms
The Operator may amend these Terms where necessary, for example to reflect changes to the Service or the law. The current version is always available on this page; the date above indicates the last revision. Continued use of the Service after a change constitutes acceptance of the amended Terms.
12. Governing law and jurisdiction
These Terms are governed by the laws of the Republic of Austria, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer-protection provisions of the country in which a consumer is habitually resident remain unaffected. Where permitted by law, the place of jurisdiction is the competent court for the Operator's registered seat.
13. Severability
If any provision of these Terms is or becomes invalid or unenforceable, the validity of the remaining provisions is not affected.
